Full access:
Full access includes 24 hour, 7 day per week dial-up demand access to the internet for News Goups, Web Browsing, Electroninc Mail, and File Transfer for one year from date of account assignment and grant of access by NetStream, Inc. Also included with full access is 4MB of space to create a web page. High volume "push" technologies, such as Pointcast, and "pull" technologies, like Real Audio and Cu-SeeMe video conferencing, are permitted.

DIAGNOSTIC VS. TECHNICAL SUPPORT

NetStream, Inc. offers free user assistance in connecting to the internet with equipment and software it sells. In rare cases where the telephone connection or user-supplied hardware or software is determined to be the cause of a malfunction, the customer account shall be assessed a diagnostic fee of $70.00 per hour.

TERMS & CONDITIONS: NetStream, Inc. strives to deliver its customers responsive and satisfactory service. However, due to the advanced technology employed by NetStream, we cannot be responsible for user supplied modems, interfaces, software, or computer systems. NetStream cannot be held responsible for poor telephone line quality or service limitations of user's phone service provider.

TERMS & CONDITIONS OF SERVICE

[Revised 5/1/01] This application is made by the person above who is an individual or the person authorized to make such application if a business. The applicant represents that he/she is at least 18 years of age at the time application is made, and that his/her use, including use by those persons authorized by applicant if family or business, of NetStream, Inc.’s services shall be lawful and limited to those explicitly listed herein.

Applicant grants permission to NetStream, Inc. or its agents to investigate the credit history as may be necessary to process and approve this application. If approved, the applicant, family, or business account shall be created and provided by NetStream, Inc. within 5-10 business days. NetStream, Inc. does not warrant the reliability or throughput of the network, nor the systems or equipment attached to the network, nor the impact or usage of the network by other NetStream customers or users. The applicant shall hold harmless NetStream, Inc., its agents, employees, related companies, successors, and assigns any and all claims, demands, actions, governmental fines, suits, payment and damages of whatsoever kind, at law or equity made against the applicant in the course of his/her use of NetStream’s services.

Applicant indemnifies NetStream, Inc. from all forms of loss, including attorney fees and damage to reputation or goodwill from any and all claims, demands, actions, governmental fines, suits, payment and damages of whatsoever kind, at law or equity in which it is named resulting from actions of the applicant through his/her use of the Internet services provided herein.

Applicant shall pay all fees and assessments promptly and maintain his/her account with NetStream. Inc. in good standing, i.e. current and not past due. Any account past due from 1-30 days shall be subject to a $10 late fee and interest at 18% per annum. Accounts past due more than 30 days shall be subject to collection for the full amount due under this application, including, but not limited to, all fees and penalties, as well as costs incurred in collecting, including attorney fees. Under no circumstances will money paid hereunder be refunded unless the application is not approved.

The term of this agreement shall extend from one year beginning on the date user is issued account or renewed. Applicant may cancel this agreement with at least 45 days of written notice to Net Stream. Applicant's account must be paid through the date of cancellation. The entire amount under this agreement shall become due for cancellations within 45 days.

This account shall be renewed automatically for a period of one year and subsequently thereafter for successive periods on the anniversary of this agreement.

Acceptable Use Policy

Introduction
NetStream, Inc.'s Acceptable Use Policy ("AUP") for NetStream's Products and Services is designed to help protect NetStream, NetStream's customers and the Internet community in general from fraud, abuse of resources, and irresponsible activities.

As an Internet Service Provider, it is not practical for NetStream to monitor the content of information passing through its network. NetStream exercises no control whatsoever over the content of any information passing through its network and is not responsible for damages customer may suffer for any reason. The persons and organizations, including NetStream customers, who publish materials and information which are accessible through NetStream networks are solely responsible for the content of such materials, and information, and are solely responsible to know and to comply with all laws applicable to the publication of such material and information. NetStream will cooperate with legal authorities in the investigation of any suspected criminal or civil infringements.

NetStream has the right to suspend or terminate the account of an offending customer without refunding fees paid or take other action as NetStream deems appropriate without notice.

Acceptable Use Guidelines

  • Child Pornography: It is illegal under Federal child exploitation statutes to possess, produce, receive, transport or distribute by any means, including computer, visual depictions of "sexual intercourse" and/or "sexually explicit conduct" involving children. NetStream will not tolerate any use of its Products and Services surrounding these activities.

  • Denial of Service: Knowingly engaging in any activities that will cause a denial-of-service (e.g., synchronized number sequence attacks) to any user, host or network.

  • Distribution of Viruses: Intentional distribution of software that attempts to and /or causes damage or annoyance to persons, data, and/or computer systems are prohibited.

  • Email / Message Forging: Forging any message header, in part or whole, of any electronic transmission, originating or passing through the NetStream network is in violation of this AUP.

  • Email Spamming or Mailbombing: Transmitting of unsolicited Email to multiple recipients, sending large amounts of Email repeatedly to a person to harass or threaten, or attempting to use NetStream servers as a mail drop or name server for spam will not be tolerated. Such offenses negatively impact system performance and are an abuse of Internet resources. Each abuse will be billed at $500 per message/recipient, and may also result in suspension or termination of service.

  • Fradulent Activities: Fraud is an intentional misrepresentation or misleading statement, writing or activity made with the intent that the person receiving it will act upon it, or obtaining or attempting to obtain service bay any means or device with intent to avoid payment.

  • Hacking or "Spoofing": NetStream will not tolerate any customer or end-user attempting to access any computer resource not belonging to that user, or attempting to penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data.

  • Network Sabotage: Any use of NetStream Products and Services to interfere with the use of Internet resources or NetStream's network by other customers or end-users.

  • Pyramid Schemes: Posting of such scams may result in legal inquiries, suspension and/or termination of service.

  • Unlawful Acts: Any use of NetStream Products and Services to violate the law or in aid of any unlawful act is strictly prohibited.

  • Usenet Spamming: Posting of messages to newsgroups that is irrelevant, blanket posting of messages to multiple newsgroups, and the posting of harassing and/or threatening messages will not be tolerated.



Violations and Enforcement

At NetStream's sole discretion, violations may result in a warning to the offender, suspension of service and/or termination of service without refund. NetStream will enforce this AUP according to the severity of the offense and violator's history of prior AUP infringements. Repeated offenses will result in immediate termination of service.

NetStream has no practical ability to monitor all conduct, communications, or content which might violate this AUP prior to its transmission on the NetStream network but may do so at its discretion. Therefore, NetStream does not assume liability for violation of the aforementioned infringements.

NetStream reserves the right to modify this AUP at any time without prior notification to customers.
